These Terms & Conditions (“Terms”) govern your access to and use of the Ship Shape Car Wash website (the “Site”) and any forms, promotions, offers, and communications you request through the Site (collectively, the “Services”). By accessing the Site, submitting information through any form, or otherwise using the Services, you agree to these Terms.

If you do not agree, do not use the Site or submit any forms.

The Site and Services are operated by Ship Shape Car Wash (“Ship Shape,” “we,” “us,” or “our”). References to “affiliates” include entities under common ownership or control and service providers working on our behalf.

2) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent that you meet this requirement.

3) Acceptable Use

You agree not to:

• Use the Site in a way that violates any law or regulation
• Attempt to gain unauthorized access to the Site or its systems
• Submit false, misleading, or incomplete information
• Interfere with or disrupt the Site’s functionality or security
• Use the Site for scraping, spamming, or distributing harmful code

We may suspend or block access to the Site for suspected misuse.

4) Forms, Information You Provide, and Your Responsibilities

When you submit a form (e.g., contact, promotions, job inquiry, quote request, membership inquiry), you agree that:

• The information you provide is accurate and up to date
• You have the right to provide any phone number and email address you submit
• You are responsible for updating your contact info if it changes

Submitting a form does not guarantee eligibility for any offer, discount, or promotion.

5) Text Message and Email Consent (Opt-In)

By providing your mobile number and/or email address on the Site, you consent to receive text messages and emails from Ship Shape Car Wash and/or its affiliates in connection with your request, including customer service, scheduling, promotions, reminders, updates, and marketing communications.

• Message Frequency: Up to 24 messages per month (may vary based on your interactions).
• No Purchase Required: Consent is not required to buy goods or services.
• Message & Data Rates: Standard message and data rates may apply.
• Autodialed/Automated: Messages may be sent using an automatic telephone dialing system or other automated technology.
• Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.

Opting Out of Text Messages

You can opt out at any time by replying STOP to any text message. After opting out, you may receive one final confirmation message. For help, reply HELP or contact us using the details in Section 16.

Email Preferences

You can unsubscribe from marketing emails at any time using the unsubscribe link in our emails. Transactional or service-related emails (e.g., confirmations, responses to requests) may still be sent if relevant.

6) Offers, Coupons, and Promotions

Unless otherwise stated in writing by Ship Shape:

• Limit: One offer per cell number
• Offers not valid with other coupons or discounts
• Offers are only good while supplies last
• Offers have no cash value and may not be sold, transferred, or substituted
• We reserve the right to modify, suspend, or end offers at any time, to the extent permitted by law
• We may refuse redemption if we reasonably believe there is fraud, abuse, or violation of these Terms

7) Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information. By using the Site and submitting forms, you agree to our Privacy Policy.

8) Intellectual Property

10) No Guarantees; Site Provided “As Is”

The Site and Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Site will be uninterrupted, secure, error-free, or that content will always be accurate or current.

11) Limitation of Liability

To the fullest extent permitted by law, Ship Shape and its affiliates, owners, employees, agents, and service providers will not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, business interruption, or reputational harm, arising out of or related to your use of the Site or Services.

In any event, our total liability for claims relating to the Site or Services will not exceed $100 or the amount you paid us for the specific service giving rise to the claim (whichever is greater), unless a different amount is required by law.

12) Indemnification

You agree to defend, indemnify, and hold harmless Ship Shape and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from:

• Your use of the Site or Services
• Your violation of these Terms
• Your violation of any law or third-party rights
• Any content or information you submit through the Site

13) Dispute Resolution; Governing Law

These Terms are governed by the laws of the State of [State], without regard to conflict of laws rules.

Any dispute arising out of or related to these Terms or the Services will be brought in the state or federal courts located in [County, State], and you consent to that jurisdiction and venue—unless applicable law requires otherwise.

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms or used the Site in a way that could create risk or legal exposure for us.

16) Mobile Detail

Service Location & Access

Customers must provide a safe, legal parking space with adequate room (at least 15 ft clearance around the vehicle). If the Detailer determines the location is unsafe or inaccessible, Ship Shape reserves the right to cancel or relocate the appointment with no refund of any deposit.

Pricing & Payment

Prices quoted are final unless additional services are requested on-site. Payment is due in full before completion of service unless pre-paid online. We accept credit/debit cards and Gift Cards sold by us. 

Cancellation & No-Show Policy 

Cancellations with more than 48 hours notice: Are able to reschedule. Cancellations with less than 24 hours notice: 50% of the service price charged. No-shows or if technician is turned away on arrival: 100% of the service price charged.

Pet Waste, Biohazard / Bodily Fluids Policy

Ship Shape Mobile Detailing does not clean blood, vomit, urine, feces, or any other bodily fluids. Vehicles containing these will be refused service with no refund of deposit or booking fee. Please have the interior professionally sanitized prior to scheduling.

Pre-Existing Damage & Liability

Customer acknowledges that the vehicle may have pre-existing scratches, swirl marks, dents, rust, stains, or interior tears. Ship Shape will document major damage with photos before starting. We are not responsible for damage that existed prior to our service. While we take the utmost care, detailing. Ship Shape is not liable for damage to aftermarket parts, loose trim, emblems, or accessories that are not properly secured.

Satisfaction Guarantee

If you are not satisfied with the service, please notify the technician immediately before they leave the premises so we can correct it on the spot at no extra charge. Claims made after the technician departs may not be honored.

Weather Policy

Appointments may be rescheduled due to rain, snow, or inclement weather.  Interior detailing requires temperatures must be above 20°F for products to work properly and safely. In freezing or near-freezing conditions we can only perform the service if you provide a heated garage or enclosed space. If no heated space is available and temperatures are below 20°F, we will reschedule with no penalty.

Late Arrival

If our technician is running late, we will notify you via text/call. If we are more than 60 minutes late, you may reschedule or cancel with a full refund.

Children & Pets

For insurance and safety reasons, children and pets must remain indoors or at a safe distance during the detailing process.

Photos & Marketing

Ship Shape reserves the right to take before/after photos of the vehicle for marketing and portfolio use. License plates and personal information will be blurred upon request.

Governing Law

This agreement shall be governed by the laws of the state in which the service is performed.
